1. Acceptance of Terms

By accessing or using LIT ChatBot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users and others who access or use the Service.

2. Description of Service

LIT ChatBot provides an AI-powered chatbot platform that allows you to embed a customizable chatbot widget on your website(s). The Service includes a customer dashboard for managing chatbots, viewing conversations, capturing leads and upgrading your plan.

We reserve the right to modify, suspend or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

• You must provide accurate, current and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized access or security breach.
• One account per person/company. Creating multiple accounts to circumvent plan limits is prohibited.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Transmit spam, unsolicited communications or malicious software.
• Impersonate any person or entity.
• Collect or harvest data from other users without their consent.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the Service in a way that could damage, disable or impair its infrastructure.
• Train competing AI models using outputs generated by our Service.
• Reproduce, duplicate or resell any part of the Service without express permission.

5. Plans and Billing

5.1 Free Plan

The Free plan is provided at no cost and includes limited chatbot quotas as specified on our Pricing page. We reserve the right to change Free plan limits with 30 days' notice.

5.2 Pro Plan

The Pro plan is a monthly subscription. Fees are billed in advance on a recurring basis. By subscribing, you authorize us to charge your payment method on each billing cycle.

5.3 Refunds

Subscription fees are non-refundable except where required by applicable law. If you cancel, your access continues until the end of the current billing period.

5.4 Price Changes

We may change our pricing with 30 days' written notice. Continued use after the effective date constitutes acceptance of the new prices.

6. Coupons and Promotions

Promotional codes and discount coupons are subject to their stated expiry dates and usage limits. They may not be combined with other offers unless explicitly stated. We reserve the right to revoke coupons in cases of abuse.

7. AI-Generated Content

The chatbot responses on your website are generated by OpenAI's language models. You acknowledge that:

• AI responses may occasionally be inaccurate, incomplete or inappropriate.
• You are responsible for configuring the knowledge base and reviewing chatbot responses for your use case.
• We are not liable for any actions taken based on AI-generated responses.
• You must not use the AI features to generate illegal, harmful or deceptive content.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

You retain ownership of all visitor data and conversation records generated through your embedded chatbot. We process this data solely to provide the Service.

9. Intellectual Property

The Service, including its design, code, graphics and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business purposes.

You may not copy, modify, distribute or reverse-engineer any part of the Service without our prior written consent.

10. Third-Party Services

The Service integrates with third-party services including OpenAI (AI responses) and Razorpay (payments). Your use of these integrations is subject to their respective terms of service. We are not responsible for the availability or conduct of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LIT ChatBot and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free or free of viruses or harmful components.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us or third parties, or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers and limitations of liability) shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before changes take effect. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
